In the great state of California,  we have what is called a “no fault dissolution/divorce”. All Parties show  that “irreconcilable differences” have occurred; therefore created  the irremediable collapse of the marriage. Another foundation on which a marriage may be ended is on the proof of incurable insanity.

Divorce process "Legal terms"

•The spouse (Party) that files the petition is called the Petitioner. (A formal written document demanding a right or benefit from a person or group in authority) for dissolution (Termination or Annulment of a formal or legal tie, bond or contract) •The other side (spouse) is served with the filed Petition. By a person or by notice of acknowledgment of receipt.•The Respondent (spouse that was served) has thirty days to file a response.•Temporary orders are requested sometimes. Hence, the filling of an  O.S.C. “Order to Show Cause”. The Judge can generate the temporary orders as to custody, at this hearing. For instance.. visitation, sale of the family home, support, or issue a restraining order if warranted.•Next state is the discovery. At this juncture, the parties swap a schedule of assets and debts, income and expense information, along with additional significant information as to the debts or assets of the marriage.•When the discovery process is thorough, the parties will come together with their respective lawyers to establish if an friendly agreement can be reached among the parties. If an agreement is attained, one of the lawyers will draw up the agreement, which will be signed by both  parties, accepted by their individual attorney, and then presented to the court.•If an agreement is not arrive at, it may be essential for the parties to move to trial and have the Judge render a decision on the matter(s).•An agreeable arrangement or orders given after trial are then submitted as the absolute divorce judgment.
